Terms of service

Last updated October 21, 2026

These Terms of Service govern access to SkillsValidator at skillsvalidator.com and the related validation, reporting and account services. The service is operated by the administrator of the skillsvalidator.com service. By creating an account, purchasing a subscription or using the service, you agree to these terms. If you act for an organization, you confirm that you have authority to bind it.

1. Who these terms cover

In these terms, the customer is the hiring organization or other business that holds the subscription, and an authorized user is a person it permits to use the account. Candidates and employees use invitation links to participate in evaluations. Candidate participation is subject to the applicable use and intellectual property provisions here, but does not create a paid subscription or make the candidate responsible for the customer's fees.

The customer is responsible for its authorized users and its configuration of the service. A written Enterprise agreement or data processing agreement takes precedence over these terms only for the matters it expressly covers. The privacy policy explains personal information processing, and the pricing page describes subscription features and limits.

2. What the service provides

SkillsValidator provides role-specific work-sample tasks, Scenario decisions and Code task validation, explain-back follow-ups, integrity signals and Skills Reports. The builder uses the role, skills, seniority and validation style to generate rubric criteria and tasks. Reports provide skill scores, quoted evidence, rubric detail and recommendation bands of strong, verify or not shown. Plan-dependent features include exports, team access controls, integrations and Talent Pool search.

The service supports the evaluation of job-related skills. Reports, scores and integrity signals inform review and do not establish a person's overall suitability, identity, future performance or legal eligibility for a job. Every integrity flag goes to human review and never causes automatic rejection. The customer makes each employment decision and checks the evidence relevant to that decision.

3. Protect account access

Provide accurate account and billing information, keep it current and use the service only with authority to represent the customer. Keep credentials confidential, use a separate authorized seat for each team member and promptly remove access that is no longer needed. Do not share credentials to avoid seat limits or give account access to unauthorized people.

Notify [email protected] promptly if you suspect unauthorized access or misuse. The administrator may take proportionate protective steps, including restricting access, to address a security concern. Account recovery and sensitive requests require verification of identity and authority. You must be legally able to enter a binding agreement to create a customer account.

4. Subscriptions renew automatically

Starter, Growth, Scale and Enterprise are available as monthly or yearly subscriptions. There is no free subscription plan, and subscriptions are not one-time purchases, credits or packs. Candidates never pay to participate in an employer's validation. The selected plan, billing interval, price and applicable taxes appear before you confirm the purchase.

Your subscription renews automatically for the same billing interval until canceled. By subscribing, you authorize recurring charges for the applicable subscription fees and taxes using the payment method on file. Keep that payment method valid. Every plan uses card payment at checkout.

Candidate allowances apply monthly, including on yearly subscriptions. Unused candidate allowances do not roll over, have no cash value and are not transferable as a balance. A completed validation that produces a Skills Report counts toward the monthly allowance. Invitations and role creation do not count as validated candidates. Active role and seat limits apply to the selected plan.

5. Change or cancel your plan

You may change your plan at any time, with proration for the remaining paid period. The adjusted charge, effective change and applicable limits are presented before confirmation. You are responsible for selecting a plan that covers the roles, candidate volume and seats your organization needs.

You may cancel at any time to stop the next automatic renewal. Access continues until the end of the paid period, subject to these terms and any lawful suspension or termination. Cancellation does not itself delete candidate records, revoke exported copies or create a refund. Export records you need before access ends and submit any deletion request separately. Contact [email protected] if you need help with cancellation.

6. Pay fees and applicable taxes

Fees are stated in USD and exclude applicable taxes unless expressly shown otherwise. The customer pays applicable sales, use and similar transaction taxes, excluding taxes on the administrator's own income. Provide accurate billing and tax information. Invoices document subscription charges, and billing questions use the support email.

Subscription fees are generally nonrefundable for unused time or unused allowances, except where applicable law or an agreed written term requires otherwise. If you believe a charge is incorrect or unauthorized, contact support promptly with your account email and invoice reference. The administrator reviews the issue and corrects a verified billing error. Nothing in these terms removes a payment right that applicable law does not allow the parties to waive.

If a payment fails or becomes overdue, the administrator may request updated payment details and suspend paid access after notice and a reasonable opportunity to resolve the issue, unless immediate action is required by law or to prevent abuse. Amounts properly due remain payable. A material subscription price change is communicated before the affected renewal, allowing the customer to cancel before it takes effect.

7. Use the service lawfully

Use SkillsValidator only for lawful, authorized evaluation and related business purposes. Do not use it for unlawful discrimination, harassment, exclusion based on protected characteristics, or any other unlawful employment practice. Do not submit material that infringes intellectual property, violates privacy, contains malicious code or includes information you lack authority to provide.

  • Do not access another person's account, private report or submission without permission.
  • Do not bypass access controls, usage limits or payment requirements.
  • Do not disrupt the service, scrape private candidate information or use Talent Pool for unrelated solicitation.
  • Do not misrepresent evidence, alter a report to mislead a reviewer or falsely claim a validated skill.
  • Do not reverse engineer the service except to the extent applicable law expressly permits it.
  • Do not submit unnecessary sensitive personal information or use tasks to obtain unpaid productive work unrelated to a genuine evaluation.

The administrator may investigate suspected misuse and restrict conduct that violates these terms. Report concerns or suspected vulnerabilities using the security guidance.

8. Keep hiring decisions with the employer

The customer chooses job-related skills, evaluates rubric relevance and applies consistent criteria to comparable candidates. The customer provides clear candidate notices about the evaluation, data collection, integrity signals, permitted assistance, recipients and retention, and obtains consent where required. It handles accommodation requests, gives reviewers appropriate context and ensures authorized human review of flags and results.

Some US jurisdictions regulate automated employment decision tools. The employer decides whether those rules apply to its use and remains responsible for applicable notices, assessments, audits, candidate rights and local requirements. SkillsValidator does not provide legal advice, legal certification, regulatory approval or guaranteed compliance. The customer must not treat an integrity signal as proof of misconduct or use a recommendation band as an automatic rejection instruction.

The customer is responsible for the lawful use of exported information, third-party integrations and shared reports, including any candidate information received through Talent Pool. It must ensure those recipients have a legitimate, authorized purpose and appropriate protection for the data.

9. Keep control of customer data

Customer data includes role information, candidate submissions, explain-back answers, integrity signals, evaluation records and reports processed for the customer. The customer retains its rights in customer data, subject to candidate and other third-party rights. Candidates retain any intellectual property rights they hold in their submissions. The customer confirms that it has the rights and lawful basis needed to provide and process the data.

The customer grants the administrator a limited right to host, transmit, reproduce and process customer data solely to deliver, secure and support the service, carry out the customer's lawful instructions and meet legal obligations. This does not transfer ownership. Candidate data is never sold and is never used to train models for other customers. Processor responsibilities, sharing categories and individual rights are described in the privacy policy.

The employer is the controller of candidate data, and the service acts as processor on its behalf. Employers set retention controls and respond to candidate requests, with service assistance where appropriate. A DPA is available on Enterprise. Confidential customer information is accessed only as needed to provide the service, under confidentiality obligations, or where disclosure is legally required. Where lawful, the administrator informs the customer about a compelled disclosure affecting its data.

10. Participate without a candidate charge

Candidates and employees complete tasks through an employer's invitation and follow the employer's communicated rules about assistance and original work. They can ask the employer about accommodations, task relevance, hiring outcomes and their records. Technical support is available by email. Candidates must not submit another person's confidential information or material they lack permission to use.

Candidates who pass can opt in to a free, portable Verified Skills profile. Profile participation is optional and separate from an employer's private evaluation records. Scale and Enterprise customers can search opted-in profiles through Talent Pool. Candidates choose whether to participate and may request profile removal. A profile records validated evidence and does not promise a job, endorsement by a regulator or future performance.

11. Try the one-time demo

The home page provides a free, one-time demo consisting of one validation build and a sample candidate, with no card required. It is not a subscription plan and does not validate your own candidates. Use the demo to inspect the task, rubric, evidence and follow-ups before choosing a paid plan.

Do not enter private candidate records, confidential work material or information you lack authority to share into the public demo. Reasonable controls prevent misuse and protect service availability. Demo output does not constitute an employment evaluation of a real applicant.

12. Respect service and content rights

The administrator and its licensors retain rights in the software, interface, service content and other materials they provide, excluding customer data and candidate-owned submissions. During the subscription, the customer receives a limited, nonexclusive right to use the service and its reports for authorized business evaluation, subject to the plan and these terms.

You may share reports with authorized reviewers and use exports as the plan permits. Do not remove rights notices, resell access or imply that a report guarantees a candidate's ability beyond the evidence shown. Generated tasks, rubrics and reports may contain errors or resemble material produced for another user, and their exclusivity or eligibility for intellectual property protection is not guaranteed.

13. Use integrations with appropriate access

Features and availability may change as the service is maintained. The administrator may perform maintenance, correct errors and update controls, and provides notice of a material change affecting paid access where reasonably practicable. Enterprise service commitments, including the 99.9 percent SLA, are governed by the applicable Enterprise agreement. No separate uptime commitment applies unless expressly agreed.

The customer authorizes the transfer of data to an external system when it enables an integration or exports information. The customer manages credentials, permissions and retention in that system. External services have their own terms, and the administrator does not control their independent operation or their handling of data after an authorized transfer.

14. Understand the service limitations

To the extent applicable law permits, the service is provided as is and as available, without implied warranties of merchantability, fitness for a particular purpose, title or noninfringement. The administrator does not warrant uninterrupted operation, error-free outputs, detection of all unauthorized assistance or a particular hiring outcome. Express commitments in an applicable written agreement remain effective.

Scores, generated rubrics and integrity signals require informed review. They do not replace professional judgment, a complete hiring process or advice from a qualified professional. Nothing here excludes a warranty or remedy that cannot lawfully be excluded.

15. Limit liability as the law permits

To the extent applicable law permits, neither party is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, business opportunity or goodwill arising from the service or these terms. These exclusions apply regardless of the legal theory and even if the possibility of such loss is known.

To the extent applicable law permits, the administrator's total liability arising from the service or these terms is limited to the subscription fees paid by the customer for the subscription term in which the event giving rise to the claim occurs. This limit does not reduce a refund or remedy required by mandatory law or an express obligation under an applicable written agreement.

Nothing excludes or limits liability for fraud, willful misconduct or any liability that applicable law does not allow to be excluded or limited. Customer payment obligations remain due. A written Enterprise agreement may provide different limits for the matters it covers.

16. End access when required

The administrator may suspend or terminate access for a material breach, unlawful use, nonpayment or a security risk. Where reasonably possible, it provides notice and an opportunity to remedy the issue before termination. Immediate restriction may be necessary to prevent harm, comply with law or protect other users. Restrictions are proportionate to the reason for action.

The customer may stop using the service and cancel renewal at any time. If the administrator permanently ends the paid service without a customer breach, it refunds prepaid fees attributable to the unused paid period. Termination does not erase fees already due or obligations that by their nature continue, including confidentiality, intellectual property, liability limits and dispute provisions.

After access ends, data is handled according to customer retention instructions, the privacy policy and applicable law. Request an export or deletion while you retain authorized access, or contact support for assistance subject to identity and authority checks. Copies exported by the customer remain its responsibility.

17. Review notices of material changes

The administrator may update these terms and publishes the revised version with its update date. Material changes are communicated through the service or account email before they take effect where required by law or reasonably practicable. Changes to paid commercial terms apply prospectively, with notice before an affected renewal when relevant.

If you do not agree to revised terms, stop using the service and cancel before they take effect. Continued use after the effective date constitutes acceptance to the extent permitted by law. Changes do not retrospectively remove accrued rights or mandatory protections.

18. Resolve questions under applicable law

These terms are governed by the laws applicable at the administrator's place of business, excluding conflict-of-law rules, subject to mandatory laws that cannot be displaced by agreement. Courts with jurisdiction under those laws hear disputes unless the parties agree otherwise in writing. Nothing here requires mandatory arbitration or removes a right that applicable law protects.

Before starting proceedings, either party may contact the other to seek a practical resolution, without limiting urgent relief or a statutory deadline. These terms and applicable written agreements form the agreement about the service. If a provision is unenforceable, the remaining provisions continue in effect. Failure to enforce a provision does not waive the right to enforce it later.

19. Contact the administrator

Send service, billing, cancellation or legal questions to [email protected]. Identify your account and the issue so the administrator of the skillsvalidator.com service can route the request. Do not send passwords or unnecessary candidate information.
